The terms and conditions of the contracting party shall only apply if expressly agreed in writing. Conclusion of Contract and Content Offers from the hotel are always non-binding. The contract comes into effect upon acceptance by the hotel. The hotel is free to confirm the room booking in writing. If the booking is made in the name and on behalf of a third party (guest), the booker (e.g., travel agency) is jointly and severally liable alongside the guest for all claims of the hotel arising from the concluded contract. Subletting and further renting of the hotel rooms provided, as well as their use for purposes other than accommodation, are generally not permitted and require prior written consent from the hotel. Unless otherwise agreed, hotel rooms are to be occupied on the day of arrival from 2:00 PM (check-in time) and vacated by no later than 10:00 AM on the day of departure (check-out time). Thereafter, the hotel may charge €50.00 for the continued use of the room until 4:00 PM due to delayed vacating; from 4:00 PM, 100% of the daily rate will be charged. This does not establish any contractual claims for the customer. Prices and ayment The hotel is obligated to hold the rooms booked by the customer and to provide the agreed services. The customer is obligated to pay the agreed price of the hotel for the accommodation and any additional services availed. This also applies to services and expenses incurred by the hotel on behalf of the customer to third parties. For services after midnight, the hotel is entitled to charge night premiums based on relevant tariffs for each commenced hour. Billing is done in euros. In the case of foreign payment methods, the currency differences and bank fees are borne by the payer. Advance payments in foreign currency will be credited at the date of valuation toward the total invoice. Invoices from the hotel are to be paid within 30 days from receipt. In the event of payment delay, the hotel is entitled to charge statutory default interest according to GvD 231/2002. The customer retains the right to prove a lesser damage, while the hotel retains the right to prove higher damages. The hotel is entitled to request an appropriate advance payment in the form of a deposit for confirmation according to Article 1385 of the Italian Civil Code. Unless otherwise expressly agreed in writing regarding the amount of the confirmation deposit and payment dates in the contract, the following advance payments are agreed: For individual bookings: 30% within 7 days from contract conclusion. For group trips: 10% at contract conclusion as a deposit 50% 90 calendar days before the arrival of the group 30% 30 calendar days before the arrival of the group Remaining balance within 30 calendar days after invoice presentation. Complaints regarding billing must be communicated to the hotel immediately after the invoice becomes known. The form of billing (recipient) must be communicated to the hotel at the time of placement or at the latest upon completion of the service. Withdrawal of the Hotel If an agreed advance payment is not made, even after the expiration of a reasonable grace period set by the hotel, the hotel is entitled to withdraw from the contract. Additionally, the hotel is entitled to withdraw from the contract for objectively justified reasons without liability for damages, for instance, if Force majeure or other circumstances not attributable to the hotel render the fulfillment of the contract impossible, Room bookings are made under misleading or false representations of essential facts, e.g., concerning the identity of the customer or the purpose, The hotel has justified cause to believe that the accommodation could jeopardize the smooth operation of the business, the safety, or the reputation of the hotel in public, provided this is not attributable to the hotel’s control or organizational scope, or A violation of the preceding point 2, c occurs. The hotel will inform the customer of the exercise of the right of withdrawal immediately. In the case of justified withdrawal by the hotel, the customer has no claim for damages. Customer Withdrawal (Cancellation, Rescheduling) / Non-utilization of Services / Early Departure A customer's withdrawal from the contract must be in writing. Cancellation: Up to 15 days before the agreed arrival day of the guest(s), the accommodation contract can be canceled without a cancellation fee by the guest or the ordering party through a unilateral written statement. For cancellations made by the guest or the ordering party between the 15th day before the agreed arrival day and the actual arrival day, they are obliged to pay the following cancellation fees: For cancellations made within 14 to 1 day before arrival, fees amounting to 30% of the total booking amount will apply. For cancellations on the day of arrival, fees amounting to 100% of the total booking amount will apply. For early departures, late arrivals, or no-shows, cancellation fees of 100% will be charged for the booked, unused days. The cancellation must be communicated through a unilateral written statement and must be in the hands of the hotel no later than within the mentioned time frames (14, 7, or 3 days) before the agreed arrival day of the guest(s). If the booked rooms are not taken for the agreed period without a cancellation, the guest or the ordering party is obliged to pay 100% of the agreed total price (the agreed price includes accommodation, meals, and any other services). If not all booked beds are occupied or canceled, the percentage will only apply to the agreed price for the unoccupied or canceled beds. For group trips (group travelers are considered those traveling together with a minimum number of 10 participants), the following terms apply: No later than 14 days before the agreed arrival day of the guests, the ordering party must inform the hotel of the number of guests in writing. If individual members of a travel group or the entire group cancel less than 30 days before the agreed arrival day of the guests, the cancellation conditions stated in point b. apply. A change in the scope of the contract due to late arrival or early departure is also considered a cancellation under the above regulation. In the case of late arrival, the guest(s) are obliged to pay the full agreed price. In the case of early departure of the guest(s), they or the ordering party are obliged to pay the price for the days utilized and 70% of the agreed price for the remaining but not utilized services. Liability of the Hotel Claims for damages, regardless of the legal basis, are excluded unless the hotel is at fault for intent or must be liable for its own gross negligence or that of its legal representatives or senior employees, as well as other assistants, or the damage claim results from a breach of essential contractual obligations. Any liability under this clause for simple negligence is limited to the typical, foreseeable damage under the contract. Liability for damages resulting from injury to life, body, or health remains unaffected. If the customer is an accommodation guest, the hotel is liable for items brought in according to Article 1783 of the Italian Civil Code, up to a hundred times the room price. Liability of the Customers The customer is liable for damages to the building and/or inventory caused by themselves, their family members, or guests according to statutory provisions. It is the customer's responsibility to insure themselves adequately against such liability cases. Final Provisions Changes or additions to the contract, including this written form clause, must be made in writing. Written communications to our customers are deemed to have been received on the third day after mailing, provided they were sent by the hotel to the last known address. In the case of transmission by fax, the sending protocol serves as proof of delivery. The same applies to written communications (mail, fax) from the customer to the hotel. A personal handover of a document by the customer is only considered effective if the document is handed over to the employee responsible for this contract, with a counter-signature. Outside business hours, a handover to third parties may only take place in exceptional cases, with counter-signature, and only to members of management. The place of performance and payment is the location of the hotel. The exclusive jurisdiction for disputes, including check and bill disputes, is Bolzano. Italian law applies. Should individual provisions of these General Terms and Conditions be ineffective or void, this does not affect the validity of the remaining provisions. Instead of the invalid provision, a valid provision that comes as close as possible to the intended purpose shall apply. The same applies in the case of contractual gaps.
